To be able to make a claim it must be shown that the accident could or should have been prevented and there was some fault on the part of the nursery, school or college.
The equipment, buildings and grounds of a nursery, school or college must be safe for use by the children or students and additionally supervision and tuition must be of a competent and safe standard.
