Successful action against school immigration decision
Zain* was permanently removed from his school because they were informed that he had an irregular immigration status.
Zain had been attending the school for 5 years and his immigration status was never questioned previously. We acted on behalf of Zain and his Litigation Friend and sent a pre action letter to the school explaining that a permanent removal from the school on the basis of our client's immigration status was not lawful. The school maintained their decision was lawful.
We subsequently issued Judicial Review proceedings. The school sought legal advice and following the High Court's consideration of the papers Zain was allowed to return to his A-Level courses with assurances that he would be permitted to complete his course and undertake any retakes, if necessary, without the fear of him being removed for the same reason.
