From 25 May 2018 the largest ever overhaul of UK data protection law will take effect that all organisations must comply with or face heavy fines and significant damage to their reputation.

The law relating to data protection and privacy generally is entering a new era as a result of a number of different developments:

  • The new EU General Data Protection Regulation (GDPR) came into force on 25 May 2018;

  • Increasing number of high-profile data breaches;

  • The demise of safe harbor in relation to data transfers to the United States.

Key changes flowing from the GDPR

A number of important new data protection obligations and rights affecting those processing personal data will soon be in force and they include:

  • Expanded scope - the new rules will apply to all organisations processing personal data in relation to EU citizens, even if they are not based in the EU;

  • Enhanced consent requirements - consent will only be validly obtained if strict requirements are met;

  • Greater accountability - organisations will be required to prove that they are complying with the new data protection rules through improved procedures and documentation;

  • New rights for individuals - these include the right to be forgotten, the right to data portability and the right to object to profiling for direct marketing purposes;

  • Data Processors now subject to the rules - for the first time, data processors will have direct obligations under data protection law;

  • Notification of data breaches – new mandatory notification to supervisory authorities and affected individuals in specified situations;

  • Significant new fines - these can potentially be up to 4% of annual worldwide turnover or €20 million, whichever is greater.
