International divorce

Securing a divorce on the breakdown of a relationship can be complex enough, even if both of you live in England and Wales. 

If one spouse has close ties with one or more countries, either as a result of one or both being a national of another country or if you have spent some time living abroad as a married couple, then it is possible to start divorce proceedings in more than one country.

An important aspect to bear in mind when considering where to issue your divorce proceedings is the existence of assets abroad and whether court orders from this country are enforceable in those specific countries.

We can advise you on whether you satisfy the criteria to proceed with your divorce in the courts of England and Wales and whether that may be the most advantageous route for you. The decision as to where to issue divorce proceedings can be an urgent one as your spouse may also wish to take advantage of the laws and entitlements in a different jurisdiction believing they favour their case and usually the first court appraised retains the case.
